Delivery of goods gets charged 19% tax if the goods are 10kg heavy or more.

However there is a EU law that covers all of the EU.

So goods that weigh less than 10kg will be tax.

(Question 1) Have I miss understood this EU law?

(Question 2) If I need to apply tax for 19% for delivery over 10kg and tax free for goods less than 10kg, how would I configure that in Opencart?

Yes - completely!
Beside the fact that this directive is valid since 1998:
Directive 97/67/EC has applied since 10 February 1998. It had to become law in EU countries by 14 February 1999.

Amending Directive 2008/6/EC has applied since 27 February 2008. It had to become law in 16 EU countries by 31 December 2010 and in the remaining 11 countries by 31 December 2012.
there is nothing stated about a price or how tax shall be applied.
Don't know from where you have this nonsens.
