What options have to comply with the consent requirements?
The new regulation states that the manifestation of consent must be unambiguous , through a declaration or a clear affirmative act .

“could include ticking a box when visiting an internet website, choosing technical settings for information society services or another statement or conduct which clearly indicates in this context the data subject's acceptance of the proposed processing of his or her personal data” in a way that “ silence, pre-ticked boxes or inactivity should not therefore constitute consent ”.

It is therefore clear that tacit consent will not be valid as of May 25 th , 2018.

El nuevo Reglamento General de Protección de Datos (RGPD) comienza a aplicarse el 25 de mayo de 2018

¿Qué opciones deben cumplir los requisitos de consentimiento?
La nueva regulación establece que la manifestación del consentimiento debe ser inequívoca, a través de una declaración o un acto afirmativo claro.

"Podría incluir marcar un casillero al visitar un sitio web de Internet, elegir ajustes técnicos para los servicios de la sociedad de la información u otra declaración o conducta que indique claramente en este contexto la aceptación por parte del interesado del procesamiento propuesto de sus datos personales" de una manera que " el silencio, las casillas previamente marcadas o la inactividad no deberían constituir un consentimiento ".

Por lo tanto, es claro que el consentimiento tácito no será válido a partir del 25 de mayo de 2018.
